Summary

Farmers are furious over new legislation forcing magistrates to accept aerial photographs as evidence in land clearing prosecutions under the Country Areas Water Supply Act. There is doubt over the proof required to show the photographs are authentic of accurate - two reasons they have been thrown out of court in two cases so far. It shifts the burden of proof from the Public Works Department to the prosecuted farmer, who is then required to disprove the authenticity and accuracy of the photographs. This legislation amendment is the latest in a series of controversies since the land clearing bans were imposed.
