Abstract
Australia has just effected significant changes to its competition law regulatory environment, following the adoption by the Commonwealth Government of the recommendations of the Harper committee. Significant to those recommendations and their adoption was conformity with overseas regulatory practice and experience. But in at least one respect, in relation to remedies, Australia's approach will remain somewhat incoherent and out of step with leading overseas jurisdictions – the availability of divestiture as a structural remedy to monopolistic conduct.
